What to know
What to weigh before commissioning custom software
The build-versus-configure decision is mostly about who carries the cost after launch. Configuration keeps a system on a supported upgrade path. Custom code transfers responsibility for security patching and dependency upgrades to whoever holds the maintenance agreement, for as long as the system runs. A practical test is to identify which parts of a process genuinely differ from those of every other organisation doing similar work; those parts are where custom development earns its cost.
Ownership does not follow payment. Under the Copyright, Designs and Patents Act 1988 the author is the first owner of copyright in work created outside employment, so legal ownership of commissioned software passes to the buyer by a written assignment signed by the assignor. A handover agreed before the build starts covers schema documentation, migration scripts, deployment instructions and a policy on what counts as a breaking API change. Acceptance testing needs entry and exit criteria set in advance, and source-code escrow, where a third party holds the code for release on agreed events, gives the buyer a route to continuity if the supplier relationship ends.
Common questions about software development
When is custom development the wrong answer?
When an established platform already covers the process and the only gap is configuration or reporting. Configuring a product and building a small integration around it is usually the better option, and the requirements stage is where that decision is made.
Who owns the source code and the data?
Ownership of source code, database schema and data is agreed in writing before development starts. So is what gets handed over at the end: build documentation, deployment steps, environment configuration and repository access.
